1. Acceptance of Terms
By registering for, accessing, or using any Primrose Hosts Services, you explicitly acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to all terms and conditions set forth herein, you must not access or use our Services. Continued use of our Services constitutes acceptance of any amendments or modifications to these Terms.
2. Eligibility
To access and use our Services, you must be at least 16 years of age, or have obtained the necessary parental or guardian consent where required by law. You represent and warrant that you have the legal capacity to enter into these Terms and to be bound by them. Primrose Hosts reserves the right to suspend or terminate accounts that do not meet eligibility requirements without prior notice.
3. Description of Services
Primrose Hosts provides hosting services including, but not limited to, virtual servers, dedicated servers, web hosting, domain registration, email hosting, and ancillary services. We reserve the right to modify, suspend, or discontinue any Services at any time, with or without notice. Service availability is subject to technical feasibility, network performance, and compliance with applicable laws. We may impose fair usage policies or service limits to ensure equitable access and service stability.
4. User Accounts and Responsibilities
Users are required to provide accurate, current, and complete information when creating accounts. Users are fully responsible for all activity conducted through their accounts, including any activity by authorized or unauthorized third parties. Account credentials must be kept secure; sharing login information or allowing unauthorized access constitutes a breach of these Terms. Users must notify Primrose Hosts immediately of any suspected unauthorized use or security breach.
5. Payments, Billing, and Refunds
All payments for Services are processed exclusively via third-party payment processors, specifically Stripe, Inc.. Primrose Hosts does not directly handle, store, or transmit payment card information. Users are subject to Stripe’s terms and privacy policies. Failure to pay applicable fees may result in immediate suspension or termination of Services. Refunds are governed by our Refund Policy and applicable UK law. Users remain liable for any outstanding charges incurred prior to termination.
6. Acceptable Use Policy and Prohibited Activities
Use of Primrose Hosts Services must comply with applicable UK law, including criminal, civil, intellectual property, and data protection laws. The following activities are strictly prohibited, and Primrose Hosts maintains a zero-tolerance policy for violations:
6. Illegal Content, Prohibited Material and Zero‑Tolerance Enforcement
6.1. Absolute Prohibition. The User acknowledges and agrees that the use of any Primrose Hosts Service to host, store, publish, upload, distribute, transmit, link to, facilitate access to, or otherwise make available any content which is unlawful, harmful, obscene, indecent, exploitative, or otherwise prohibited under applicable law is strictly and absolutely prohibited. This prohibition includes, without limitation, content that: (a) constitutes or facilitates a criminal offence; (b) is obscene, pornographic, or indecent where prohibited by law; (c) constitutes child sexual abuse material or any sexual content involving persons who are, or appear to be, under the age of 18; (d) depicts, promotes, or glorifies extreme violence, bestiality, torture, or gratuitous physical injury (collectively “Prohibited Material”); (e) infringes the intellectual property or privacy rights of third parties; or (f) otherwise breaches UK criminal law, including but not limited to the Computer Misuse Act 1990, the Copyright, Designs and Patents Act 1988, the Protection of Children Act 1978, the Sexual Offences Act 2003, and any applicable international equivalent.
6.2. Illustrative Examples (non‑exhaustive). For clarity, the following examples are strictly prohibited and will result in immediate action: distribution or storage of child sexual abuse material (CSAM), trafficking or sale of sexual content involving minors, hosting or dissemination of content that provides instructions for criminal activity (including hacking, building weapons, or committing fraud), hosting ransomware or malware distribution platforms, offering or facilitating services that enable sexual exploitation or human trafficking, distributing "snuff", graphic gore with intent to shock paired with criminal conduct, and any site or service that functions primarily to facilitate illegal marketplaces or illicit services.
6.3. Zero‑Tolerance Enforcement Policy. Primrose Hosts enforces a zero‑tolerance policy with respect to Prohibited Material. Where we have a reasonable belief, on the basis of objective evidence, that an account, site, service, or hosted content contains, distributes, or facilitates Prohibited Material, we shall (without limitation and at our sole discretion) take any or all of the following actions immediately and without prior notice:
- temporary suspension of network connectivity and/or hosting services;
- immediate termination of the account and removal of all associated content;
- preservation and secure retention of forensic evidence, logs, and copies of offending content for the purposes of law enforcement and legal process;
- disclosure of account information, account identifiers, IP addresses, usage logs, stored content, communications, billing data, and other metadata to law enforcement, regulators, and rights‑holders as required or permitted by law;
- blocking access to content or resources in applicable jurisdictions to prevent further dissemination.
6.4. Mandatory Reporting & Cooperation. In the event of suspected CSAM, exploitation of minors, suspected terrorism content, or other serious criminal activity, Primrose Hosts shall report the matter to the appropriate authorities and child protection agencies (including, where applicable, the National Crime Agency, local police forces, and internationally recognised hotlines). We will cooperate fully with lawful requests from law enforcement and regulatory agencies, including by providing preserved evidence, forensic analysis, and sworn statements when required. Where permitted by law, we will also notify affected users or account holders; however, notification may be withheld if it would impede an investigation or is prohibited by law.
6.5. Preservation of Evidence. Where Prohibited Material is suspected, Primrose Hosts will preserve forensic evidence in a secure and tamper‑evident manner. Such preservation may include full disk images, backups, server logs, HTTP logs, email logs, DNS records, account registration information, transactional and billing records, and other metadata. Primrose Hosts reserves the right to retain such evidence for a reasonable period even after account termination for the purpose of criminal investigations, civil litigation, or regulatory compliance.
6.6. User Obligations and Representations. By using Primrose Hosts Services the User represents, warrants and covenants that:
- the User will not upload, host, or distribute any Prohibited Material;
- the User has implemented commercially reasonable content control measures where applicable (e.g., age verification for lawful adult services, content moderation where services enable user uploads);
- the User will cooperate with Primrose Hosts’ reasonable requests for information relating to potential breaches of these Terms and will comply with take‑down instructions issued by Primrose Hosts or pursuant to applicable law;
- the User will not attempt to obfuscate, conceal, or delete content or logs in order to hinder any investigation; and
- the User will indemnify and hold Primrose Hosts harmless for any loss, damage, cost or liability arising from the User’s breach of this Section 6.
6.7. Takedown, Notice and Counter‑Notice Procedure. Primrose Hosts maintains a takedown process designed to address allegations of unlawful or infringing content. Where we receive a credible notice alleging unlawful or infringing content, we will take steps including temporary removal or disabling of access to the content and notification to the account holder. Where applicable, and to the extent required by law, we will provide the account holder with an opportunity to submit a counter‑notice or explanation. Notwithstanding any counter‑notice, Primrose Hosts reserves the right to maintain removal or suspension where ongoing risk to third parties, law enforcement investigations, or legal obligations justify continued restriction.
6.8. Indemnity and Liability for Prohibited Material. The User shall indemnify, defend and hold Primrose Hosts, its officers, directors, employees and agents harmless against all claims, liability, damages, costs and expenses (including reasonable legal fees) arising from or related to: (a) any Prohibited Material hosted, stored, or transmitted using the User’s account or services; (b) the User’s failure to comply with the provisions of this Section 6; or (c) any claim, suit or action brought by a third party or authority in connection with allegations that content or activity associated with the User’s account violates law.
6.9. Civil and Criminal Consequences. The User acknowledges that hosting, distributing, or facilitating Prohibited Material may expose the User to serious civil claims and criminal prosecution. Primrose Hosts does not accept liability for any legal consequences faced by the User arising from unlawful content. We reserve the right to initiate civil or injunctive proceedings against Users suspected of willful or repeated violations of these Terms, and to recover all costs incurred in connection with enforcement actions.
6.10. Monitoring and Detection. While Primrose Hosts does not undertake general monitoring of all user content, we employ automated detection systems, abuse reporting channels, customer support monitoring, and other measures reasonably designed to detect Prohibited Material and abnormal or suspicious behaviour. Use of such systems shall be without prejudice to our right to rely on user reports, third‑party notices, or law enforcement disclosures in identifying violations.
6.11. Cross‑Border Content and Jurisdictional Blocking. The User acknowledges that laws governing content vary by jurisdiction. Primrose Hosts may, at its discretion, restrict access to content in certain jurisdictions by implementing geoblocking, DNS blocks, or other technical measures where required by law or to mitigate legal risk.
6.12. Preservation of Primrose Hosts’ Rights. Nothing in this Section 6 shall limit or prejudice any other rights or remedies available to Primrose Hosts under these Terms, at law or in equity, including the right to terminate any User’s access without liability, to pursue injunctive relief, and to cooperate fully with law enforcement and regulators.
6.13. Reporting Abuse. Users, third parties or rights‑holders who become aware of suspected Prohibited Material hosted on Primrose Hosts infrastructure should immediately report such material through Primrose Hosts’ published abuse channels at /support or via the designated abuse email. Reports should include sufficient detail and evidence (e.g., URLs, timestamps, copies of offending files) to enable Primrose Hosts to conduct an initial assessment. False or malicious reporting is prohibited and may give rise to legal consequences.
6.14. Survival. The obligations, restrictions, rights and remedies set forth in this Section 6 shall survive termination of the User’s account and shall remain enforceable to the fullest extent permitted by law.
Zero Tolerance Enforcement: Accounts engaged in illegal or prohibited activities will be suspended or terminated immediately without notice. Primrose Hosts reserves the right to report all violations to law enforcement or regulatory authorities, including the National Crime Agency, UK Police Authorities, or other relevant bodies. We may provide all relevant data, including IP addresses, account activity logs, and communications to authorities. Users may be held personally liable for all illegal actions conducted through our Services, including criminal and civil liabilities.
This zero-tolerance policy includes, but is not limited to, violations of the UK Computer Misuse Act 1990, Copyright, Designs and Patents Act 1988, Consumer Rights Act 2015, Regulation of Investigatory Powers Act 2000, and any applicable international law.
Users are responsible for ensuring that all content hosted, shared, or transmitted via our Services is fully compliant with applicable law. Ignorance of these legal obligations will not excuse violations, and users acknowledge full accountability for all actions undertaken within their accounts.
7. Intellectual Property Rights
All intellectual property rights associated with Primrose Hosts’ infrastructure, branding, software, and documentation remain the exclusive property of Primrose Hosts or its licensors. Users may not reproduce, distribute, or create derivative works without explicit written consent. Any unauthorized use constitutes a material breach of these Terms.
8. Limitation of Liability and Indemnification
To the maximum extent permitted by law, Primrose Hosts shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use or inability to use our Services. Users agree to indemnify, defend, and hold harmless Primrose Hosts, its directors, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from user violations of these Terms, including illegal content, data breaches, or infringement of third-party rights. Our total liability to any user shall not exceed the fees paid by the user for the affected service during the preceding 12 months.
9. Termination and Suspension
Primrose Hosts reserves the right to suspend or terminate Services for any reason, including breach of Terms, non-payment, illegal activity, or regulatory compliance requirements. Termination does not affect accrued rights, outstanding payments, or legal obligations. Users acknowledge that termination may result in permanent loss of data after any required retention period. We may retain limited data to comply with applicable laws, prevent fraud, or enforce these Terms.
10. Data Protection and GDPR
Primrose Hosts processes personal data in accordance with the UK Data Protection Act 2018 and the principles of the General Data Protection Regulation (GDPR). Users are informed that Primrose Hosts is not formally certified under GDPR and accept this limitation. Financial and billing data is handled exclusively by Stripe. Users may exercise rights to access, rectify, erase, restrict, or object to processing, as applicable, via our support team. Primrose Hosts implements reasonable technical and organisational measures to protect personal data from unauthorized access or disclosure.
11. Amendments to Terms
Primrose Hosts reserves the right to amend or update these Terms at any time. Updated Terms will be posted on our website and take immediate effect. Continued use of Services constitutes acceptance of any amended Terms. Users are encouraged to review these Terms periodically to remain informed of updates or modifications.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising from or in connection with these Terms or the use of Services shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these Terms affects statutory consumer rights under the Consumer Rights Act 2015 or any other applicable legislation.
